Terms and Conditions of Use

1. Acceptance of Terms

Welcome to Levante Platform ("Levante", "we", "our" or "the Platform"). These Terms and Conditions of Use ("Terms") constitute a legally binding agreement between you ("User", "you" or "your") and Saul Gomez Jimenez, domiciled in Spain ("Owner").

By accessing, registering for, or using Levante Platform, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you should not access or use our services.

Your continued use of the Platform after the publication of changes to these Terms constitutes your acceptance of such changes.

2. Description of Service

Levante is an API gateway platform that provides access to multiple large language models (LLMs) through a unified interface. Our services include:

• Access to various LLM models from multiple providers
• API key management for application integration
• Prepaid credits system (pay-as-you-go) for API consumption
• Dashboard for usage monitoring and account management
• Documentation and developer tools

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without prior notice.

3. Registration and User Accounts

To use certain Levante services, you must create an account. By registering, you agree to:

• Provide truthful, accurate, current, and complete information during the registration process
• Maintain and update your information to keep it truthful, accurate, current, and complete
• Maintain the confidentiality of your password and API keys
• Be responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or cancel your account if any information provided proves to be false, inaccurate, outdated, or incomplete.

You are solely responsible for the security of your access credentials. We recommend using strong passwords and not sharing your API keys with third parties.

4. Minimum Age

To use Levante Platform, you must be at least 14 years of age. If you are under 18, you represent that you have the consent of your parents or legal guardians to use the Platform.

We reserve the right to request proof of age at any time and to suspend or cancel accounts if we determine that the user does not meet the minimum age requirement.

5. Use of Service

You agree to use Levante Platform responsibly and in compliance with the law. The use of our services is subject to our Acceptable Use Policy, which forms an integral part of these Terms.

Without prejudice to the foregoing, you agree NOT to use the Platform to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of third parties
• Transmit illegal, harmful, threatening, abusive, or objectionable content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with the normal operation of the Platform
• Reverse engineer our services
• Use the API to create direct competing services
• Share your access credentials with unauthorized third parties

Failure to comply with these provisions may result in the immediate suspension or termination of your account, without the right to a refund.

6. Payments and Credits System

Levante operates under a pay-as-you-go model. Users purchase credits that are consumed when using the API according to the current rates for each model.

6.1 Credit Purchases

• Credits are purchased through the payment methods accepted on the Platform
• Prices are displayed in the indicated currency and may include applicable taxes
• Credits do not expire as long as your account remains active
• Credits are not transferable between accounts

6.2 Credit Consumption

• The cost per request varies depending on the model used and the tokens processed
• Current rates are available on our pricing page
• We reserve the right to modify rates with prior notice

6.3 Refunds

Refund policies are detailed in our Refund Policy. In general, purchased credits are non-refundable except in the cases expressly provided in said policy or when required by applicable law.

7. Intellectual Property

7.1 Our Intellectual Property

Levante Platform, including its design, logos, trademarks, source code, documentation, and all original content, are the exclusive property of the Owner or its licensors. These elements are protected by Spanish and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for the purposes set forth in these Terms.

7.2 Your Content

You retain all rights to the content you submit through our API. By using our services, you grant us a limited license to process your content solely for the purpose of providing the requested service.

We do not claim ownership of the responses generated by the LLM models in response to your requests.

8. Limitation of Liability

8.1 In no event shall the Owner, its officers, employees, agents, or suppliers be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, data, use, goodwill, or other intangible losses.

8.2 The total aggregate liability of the Owner for any claim arising out of or related to these Terms or the use of the Platform shall not exceed the total amount paid by you during the three (3) months immediately preceding the event giving rise to the claim.

8.3 The foregoing limitations shall apply regardless of whether the Owner has been advised of the possibility of such damages and regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.

8.4 Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Disclaimer of Warranties

The Owner expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Platform will operate without interruption, will be secure, or will be error-free
• That the results obtained through the Platform will be accurate or reliable
• That any defects will be corrected
• The continued availability of any specific LLM model

You use the Platform at your own risk. You are solely responsible for evaluating the accuracy, completeness, and usefulness of any content obtained through the services.

10. Service Modifications

We reserve the right to modify, update, or discontinue any aspect of Levante Platform at any time, including:

• Adding, modifying, or removing features
• Changing the available LLM models
• Modifying rates (with reasonable prior notice)
• Updating the underlying infrastructure and technology
• Imposing limits on service usage

For significant changes that negatively affect your use of the service, we will make reasonable efforts to notify you in advance through the email address associated with your account or through a notice on the Platform.

11. Account Termination

11.1 Termination by User

You may cancel your account at any time through your account settings or by contacting us directly. Upon cancellation, you will lose access to the services and any remaining credits in your account.

11.2 Termination by Owner

We reserve the right to suspend or terminate your account, with or without prior notice, for the following reasons:

• Violation of these Terms or the Acceptable Use Policy
• Fraudulent or illegal activity
• Non-payment or recurring payment disputes
• Prolonged account inactivity
• At our discretion, for any legitimate business reason

11.3 Effects of Termination

Upon termination: (a) your right to access and use the Platform will cease; (b) we shall have no obligation to maintain or provide your data; (c) unused credits will be forfeited, unless applicable law provides otherwise; (d) provisions that by their nature should survive termination shall remain in effect.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of laws provisions.

For any dispute arising out of or related to these Terms or the use of the Platform, the parties agree to submit to the exclusive jurisdiction of the competent courts of Spain.

If you are a consumer residing in the European Union, you may benefit from the mandatory consumer protection provisions of your country of residence, and you may file claims before the courts of your place of residence.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last updated" date at the top of this document
• We will notify you by email or through a prominent notice on the Platform
• We will provide a reasonable period to review the changes before they take effect

Your continued use of the Platform after the new Terms take effect constitutes your acceptance of them. If you do not agree with the changes, you should stop using the Platform and cancel your account.

15.1 Entire Agreement

These Terms, together with the Privacy Policy, the Acceptable Use Policy and the Refund Policy, constitute the entire agreement between you and the Owner regarding the use of the Platform.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

The failure to exercise any right or provision of these Terms shall not constitute a waiver of such right or provision.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
